Student Accommodation SA Property Landlord Terms and Conditions

Effective Date: 18 August 2026

These Terms and Conditions govern the use of the Student Accommodation SA platform (“Platform”) by property landlords, accommodation providers, agencies, property managers, and authorised representatives (“Landlord”).

By listing accommodation on Student Accommodation SA, you agree to be bound by these Terms and Conditions.

1. About Student Accommodation SA

1.1 Student Accommodation SA operates an online platform that connects students seeking accommodation with private student accommodation providers throughout South Africa.

1.2 Student Accommodation SA acts solely as a marketing, advertising, lead generation, referral and student placement platform.

1.3 Student Accommodation SA is not a landlord, tenant, property manager, rental agent or party to any lease agreement concluded between a Landlord and a Student.

1.4 Any lease agreement is concluded directly between the Landlord and the Student.

2. Landlord Eligibility

2.1 The Landlord warrants and represents that they:

  • are the lawful owner of the property; or
  • have the lawful authority, written consent, mandate or other necessary authorisation from the owner to advertise, market, offer and/or lease the property.

2.2 Student Accommodation SA reserves the right, at any time and in its sole discretion, to request documentation or information reasonably necessary to verify the Landlord, the property and/or the Landlord’s authority to advertise or lease the property. This may include, but is not limited to:

  • proof of ownership;
  • written authority or mandate from the lawful owner;
  • accreditation or approval documentation;
  • municipal approvals or compliance documentation;
  • company registration and/or business documents;
  • identification documents; and
  • any other documentation reasonably required for verification, compliance or fraud prevention purposes.

2.3 The Landlord shall immediately notify Student Accommodation SA in writing of any change affecting the ownership, authority, management, accreditation, compliance status or operation of the property.

2.4 The Landlord acknowledges that Student Accommodation SA is entitled to suspend, remove or decline a property listing where the required verification documents are not provided, are incomplete, cannot be reasonably verified, or where Student Accommodation SA has reasonable grounds to believe that the Landlord does not have the necessary authority to advertise or lease the property.

2.5 The Landlord remains solely responsible for ensuring that all information and documentation supplied to Student Accommodation SA is true, accurate, current and not misleading.

2.6 The Landlord indemnifies Student Accommodation SA against any claim, loss, damage, liability, cost or expense arising from the Landlord’s failure to have the necessary ownership rights, authority, consent, accreditation or approval to advertise or lease the property.

3. Property Standards

3.1 All accommodation listed on the Platform must be safe, habitable, clean and suitable for student occupation.

3.2 The Landlord warrants that the property complies with all applicable laws, regulations, municipal by-laws and health and safety requirements.

3.3 Accommodation must substantially match the description, photographs and information displayed on the Platform.

3.4 Student Accommodation SA reserves the right to request updated photographs, videos, inspections or supporting documentation relating to the property.

3.5 Student Accommodation SA may suspend or remove a property listing if it reasonably believes the accommodation:

  • is unsafe;
  • is unhygienic;
  • is materially different from the advertised listing;
  • creates a risk to students;
  • does not meet acceptable accommodation standards; or
  • damages the reputation of the Platform.

4. Accuracy of Listings

4.1 The Landlord warrants that all information provided to Student Accommodation SA is accurate, truthful and not misleading.

4.2 This includes but is not limited to:

  • rental amounts;
  • deposit requirements;
  • availability;
  • room types;
  • occupancy limits;
  • facilities;
  • internet services;
  • utilities;
  • security features;
  • accreditation status;
  • property location;
  • house rules;
  • photographs and videos.

4.3 The Landlord shall immediately update any information that becomes inaccurate or outdated.

4.4 Student Accommodation SA reserves the right to amend, reformat, improve, edit or update listing content for presentation and marketing purposes.

5. Student Treatment

5.1 Landlords shall treat all students fairly, respectfully and professionally.

5.2 Landlords may not:

  • harass students;
  • intimidate students;
  • threaten students;
  • discriminate unlawfully against students;
  • engage in abusive conduct;
  • exploit students financially; or
  • violate students’ legal rights.

5.3 Repeated complaints from students, parents, guardians, educational institutions or other stakeholders may result in suspension or removal from the Platform.

5.4 Student Accommodation SA may investigate complaints and Landlords agree to cooperate fully with such investigations.

6. Listings and Marketing

6.1 Student Accommodation SA may publish, market and promote listed properties through:

  • the Platform;
  • social media;
  • digital advertising;
  • email campaigns;
  • printed material;
  • third-party marketing partners.

6.2 By submitting photographs, videos, descriptions and other content, the Landlord grants Student Accommodation SA a non-exclusive, royalty-free licence to use such content for marketing and promotional purposes.

6.3 Student Accommodation SA may edit, crop, resize, translate, rewrite or otherwise adapt content supplied by the Landlord.

6.4 Student Accommodation SA may determine the ranking, placement and visibility of listings at its sole discretion.

7. Assisted Placement Service

7.1 Student Accommodation SA offers an Assisted Placement Service under which Student Accommodation SA markets accommodation, generates student enquiries and refers prospective students to the Landlord.

7.2 Student Accommodation SA may:

  • advertise the property;
  • promote available rooms;
  • handle student enquiries;
  • process applications;
  • refer suitable students;
  • assist with placement administration;
  • assist with lease completion processes.

7.3 Student Accommodation SA does not guarantee occupancy levels, student placements or rental income.

8. Landlord Responsibilities

The Landlord retains full control and responsibility for:

  • property management;
  • student screening;
  • student approval;
  • lease agreements;
  • rental collection;
  • deposit collection;
  • maintenance;
  • student relations;
  • evictions;
  • compliance with applicable laws.

Student Accommodation SA assumes no responsibility for the management or operation of the accommodation.

9. Placement Fees

9.1 The Landlord agrees to pay Student Accommodation SA a placement fee of R1,500.00 (One Thousand Five Hundred Rand), excluding VAT, for each successful student placement for the 2027 academic year.

9.2 VAT shall be added to the placement fee where applicable.

9.3 A placement shall be deemed successful when:

  • a student introduced directly or indirectly through Student Accommodation SA is accepted by the Landlord for accommodation for the 2027 academic year; and
  • a lease agreement is signed, concluded or otherwise completed between the Landlord and the student.

9.4 The placement fee becomes immediately due and payable upon completion of the lease agreement.

9.5 Student Accommodation SA may issue an invoice immediately upon confirmation of the completed lease agreement.

9.6 The Landlord agrees to provide reasonable proof of lease completion if requested by Student Accommodation SA.

9.7 The placement fee stated in this clause applies specifically to placements for the 2027 academic year. Any placement fee applicable to subsequent academic years shall be communicated and/or agreed separately by Student Accommodation SA.

10. Non-Circumvention

10.1 A Landlord may not circumvent Student Accommodation SA to avoid paying placement fees.

10.2 If a student is introduced to the Landlord through:

  • the Platform;
  • Student Accommodation SA staff;
  • social media marketing;
  • advertising campaigns;
  • referrals;
  • lead generation activities;

and subsequently signs a lease agreement with the Landlord within twelve (12) months of the introduction, the placement fee remains payable.

10.3 This applies regardless of whether:

  • communication occurs directly between the Landlord and Student;
  • the transaction occurs outside the Platform;
  • the Landlord uses another representative, agency or employee to conclude the lease.

10.4 Any attempt to avoid or circumvent placement fees shall constitute a material breach of these Terms.

11. Failure to Pay Fees

11.1 If a Landlord fails to pay any amount due to Student Accommodation SA, Student Accommodation SA may:

  • suspend listings;
  • remove listings;
  • suspend enquiries;
  • refuse future referrals;
  • recover outstanding amounts through legal proceedings;
  • charge interest on overdue amounts at the maximum rate permitted by law.

11.2 Student Accommodation SA may recover all reasonable legal costs and debt collection costs incurred in recovering outstanding fees.

11.3 Removal of a property does not extinguish any debt owed to Student Accommodation SA.

12. No Right to Remain Listed

12.1 No Landlord has any automatic or ongoing right to be listed on the Platform.

12.2 Student Accommodation SA may refuse, suspend or remove any listing at its discretion.

12.3 Student Accommodation SA shall not be liable for any losses resulting from the suspension or removal of a listing.

13. Right to Remove or Delist Properties

13.1 Student Accommodation SA reserves the right to remove, suspend or permanently delist any property at any time.

13.2 Reasons for removal may include:

  • poor accommodation standards;
  • safety concerns;
  • failure to pay placement fees;
  • misleading advertising;
  • fraudulent conduct;
  • student complaints;
  • unprofessional conduct;
  • abuse of students;
  • non-compliance with applicable laws;
  • failure to cooperate with investigations;
  • damage to the reputation of Student Accommodation SA.

13.3 Student Accommodation SA shall not be required to provide reasons for delisting.

14. Change of Ownership

14.1 If ownership, management or control of the property changes, the Landlord must immediately notify Student Accommodation SA.

14.2 Existing obligations arising from student placements introduced through Student Accommodation SA shall survive any change in ownership or management.

15. Personal Information (POPIA)

15.1 Landlords shall comply with the Protection of Personal Information Act, 2013 (“POPIA”).

15.2 Student information obtained through the Platform may only be used for accommodation-related purposes.

15.3 Landlords may not sell, share, distribute or misuse student information.

15.4 Any actual or suspected data breach involving student information must be reported to Student Accommodation SA immediately.

16. Reviews and Complaints

16.1 Student Accommodation SA may publish reviews, ratings and feedback concerning properties.

16.2 Student Accommodation SA may investigate complaints received from students, parents, universities or other stakeholders.

16.3 Student Accommodation SA may rely on such complaints when deciding whether to retain, suspend or remove a property listing.

17. Limitation of Liability

17.1 Student Accommodation SA acts solely as a marketing and placement platform.

17.2 Student Accommodation SA shall not be liable for:

  • student conduct;
  • rental disputes;
  • non-payment of rent;
  • property damage;
  • theft;
  • lease disputes;
  • student misconduct;
  • maintenance issues;
  • property management failures.

17.3 Student Accommodation SA shall not be liable for indirect, consequential or special damages arising from use of the Platform.

18. Indemnity

18.1 The Owner indemnifies and holds harmless Student Accommodation SA, its directors, employees, contractors and representatives from and against any and all claims, damages, losses, expenses, costs or liabilities arising from or relating to:

  • the property;
  • the provision of student accommodation;
  • the Owner’s conduct, acts or omissions;
  • any lease agreement between the Owner and a student;
  • the management, maintenance or operation of the property;
  • any breach of these Terms by the Owner;
  • any violation of applicable law, regulation or municipal requirement by the Owner;
  • any breach, cancellation, termination, repudiation or non-performance of a lease agreement by a student; and
  • any loss of rental income, vacancy, costs or other losses suffered by the Owner as a result of a student failing to comply with, cancelling or terminating their lease agreement.

18.2 Student Accommodation SA acts as an accommodation advertising and placement platform and does not guarantee that a student will remain in the property for the full duration of a lease agreement or that the Owner will receive rental income for the full lease period.

18.3 The Landlord acknowledges that Student Accommodation SA is not responsible for any dispute between the Owner and a student arising from or relating to a lease agreement, including disputes concerning cancellation, early termination, non-payment, breach of house rules, damage to the property or failure by a student to fulfil their contractual obligations.

18.4 The indemnity in this clause shall not apply to the extent that a claim, loss or liability is directly caused by the gross negligence or wilful misconduct of Student Accommodation SA.

19. Governing Law

19.1 These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

19.2 Any dispute arising from these Terms shall be subject to the jurisdiction of South African courts.

20. Changes to Terms

20.1 Student Accommodation SA may amend these Terms from time to time.

20.2 Updated Terms will be published on the Platform and shall become effective upon publication.

20.3 Continued use of the Platform constitutes acceptance of the amended Terms.
